Nothing in these Terms limits the mandatory rights granted to consumers under applicable law.

Fixed-term access to selected Envol content or features, available for purchase through the Website or through the App, under the conditions displayed at the time of purchase.

e. Additional Content and Services

Other educational, digital, or in-person experiences that Envol may introduce from time to time.

The content, availability, prices, features, and conditions of individual products or services are described on their respective pages.

3. Eligibility and Accounts

Certain Services may require you to create an account, while others may be purchased or accessed without a Website account.

When creating an account, you agree to provide accurate information and to keep your login credentials confidential.

You are responsible for activity undertaken through your account, except where otherwise provided by applicable law.

You must notify Envol promptly if you believe your account has been accessed without authorization.

The Services are primarily intended for adults aged 18 or older.

4. Envol Mobile Application

The Envol mobile application offers audio-based experiences designed to support users in their everyday lives.

Through its Press for Relief experience, users can choose how they are feeling at a particular moment and access audio experiences tailored to different needs, such as pain, fatigue, anxiety, stress, overstimulation, or difficulty sleeping.

These experiences may combine selected sound frequencies, guided relaxation techniques, meditations, breathing exercises, and other mind-body approaches.

The App may offer free features, paid content, and different levels of access. The features available within each plan are described in the App or on the applicable purchase page.

Some features may require an internet connection, a compatible device, or an updated version of the App.

Envol may update the App, introduce new features, improve existing experiences, or discontinue particular features, subject to applicable contractual and consumer rights.

The App is intended to support well-being and complement appropriate healthcare. It does not replace medical consultation, diagnosis, or treatment.

5. Fixed-Term Purchases and Subscriptions

5.1 Website purchases

Access plans sold directly through envol.health are offered as fixed-term purchases without automatic renewal.

The duration, price, included features, and access conditions are displayed before purchase.

Unless expressly stated otherwise at checkout, purchasing an access plan on the Website does not authorize Envol to charge the customer automatically for another period.

At the end of the purchased access period, paid access expires unless the customer makes another purchase or has access through a separate active arrangement.

5.2 In-App Subscriptions

Subscriptions purchased through the Apple App Store or Google Play may be subject to different payment and renewal conditions.

Where an in-app subscription renews automatically, the applicable renewal terms, price, billing interval, and cancellation procedures are presented by the relevant app store before purchase.

Users can manage eligible in-app subscriptions through the account settings provided by the relevant app store.

Deleting the App does not, by itself, cancel an automatically renewing subscription.

5.3 Access and Activation

After successful payment, Envol will provide access according to the conditions described at checkout.

5.4 Changes to Plans

Changes to prices or product offerings do not retroactively change a completed fixed-term purchase.

If any ongoing digital service is materially changed during an active contractual period, Envol will comply with applicable notice, conformity, and termination requirements.

6. Website Orders and Payments

Products and services offered through the Website are described on their respective purchase pages.

Before completing an order, customers will be shown the applicable price, taxes, payment conditions, product duration, and any additional charges.

Payments may be processed by authorized third-party payment providers.

Envol does not require customers to provide payment card details directly to Envol outside the payment methods made available through checkout.

An order is confirmed when the customer receives confirmation from Envol or its authorized payment system, subject to any conditions clearly communicated before purchase.

Where access cannot be delivered as agreed, Envol will provide an appropriate solution in accordance with applicable consumer law.

Envol may refuse or cancel an order where there is a legitimate reason, such as suspected fraud, a material pricing error, or inability to provide the purchased service, subject to applicable law and any reimbursement obligations.

7. Back to Health and Other Programs

Envol may offer structured programs designed to support personal development and well-being.

Each program is governed by the description and specific conditions provided at the time of registration.

A program may include:

  • Educational materials and guides.
  • Recorded audio experiences and exercises.
  • Live online sessions.
  • Group sessions.
  • Individual sessions.
  • Personalized audio experiences.
  • Other resources described in the applicable program offer.

The precise format, schedule, duration, participation requirements, and included elements depend on the program purchased.

Personalized materials may require participants to complete questionnaires or provide information necessary for the service.

Program activities are educational and supportive in nature. They do not constitute medical diagnosis, treatment, or psychotherapy unless explicitly delivered by an appropriately qualified professional acting within their professional scope.

Participants remain responsible for their own health decisions and should continue appropriate medical care.

Envol does not guarantee particular health outcomes or improvements in symptoms.

7.1 Back to Health Money-Back Guarantee

Envol offers a 30-day money-back guarantee for the Back to Health program, beginning when the program starts.

A participant requesting cancellation within the first 30 days of the program may request a refund of payments made for the program, excluding applicable fees as specified below, subject to mandatory consumer rights.

If the program guide has already been received, a one-time fee of €75 for the guide is non-refundable under this commercial guarantee.

Refunds under this commercial guarantee do not limit statutory withdrawal, conformity, or reimbursement rights.

7.2 Program Cancellations and Changes

If Envol needs to reschedule an individual or group session, we will make reasonable efforts to provide an alternative.

Material changes, cancellations, and unprovided services will be handled in accordance with the program’s specific terms and applicable law.

8. Envol Retreats

Envol organizes in-person retreats offering opportunities for personal development and well-being.

Each retreat has its own description specifying:

  • Dates and location.
  • Accommodation and room categories.
  • Activities, sessions, and other included services.
  • Price and payment schedule.
  • Any applicable exclusions or additional costs.
  • Arrival and departure arrangements.
  • Relevant participation requirements.

A retreat booking becomes confirmed in accordance with the booking and payment conditions presented at the time of purchase.

Participants are responsible for reviewing the information provided before booking and communicating relevant logistical or accessibility requirements.

Travel to and from the retreat, insurance, and other personal expenses are the participant’s responsibility unless expressly included in the retreat offer.

8.1 Retreat Cancellation and Refund Policy

The following commercial cancellation policy applies to participant-initiated cancellations, subject to mandatory legal rights:

Refund policy:

  • 90 days or more before the retreat start date: Full refund of the deposit, less a €50 administrative cancellation fee and any non-refundable payment or transfer fees.
  • 60–89 days before the retreat start date: Refund of 50% of the deposit, less a €50 administrative cancellation fee and any non-refundable payment or transfer fees.
  • 59 days or fewer before the retreat start date: The deposit is non-refundable unless we are able to fill your spot with another participant.

The €50 administrative fee covers the processing of the cancellation and refund.

Payment processing, bank transfer, currency conversion, and other transaction fees incurred in connection with the booking are non-refundable to the extent permitted by applicable law.

This cancellation policy reflects the advance commitments made for accommodation, meals, instructors, and other arrangements.

Nothing in this policy excludes rights that participants may have under mandatory consumer or travel law.

8.2 Changes or Cancellation by Envol

Envol may need to make reasonable changes to retreat activities, schedules, facilitators, or other arrangements.

If a retreat is cancelled by Envol or materially changed, participants will be informed and provided with the remedies required under applicable law.

8.3 Health and Participation

Participants should assess whether the retreat activities are appropriate for their individual circumstances.

Participants with particular health, mobility, accessibility, dietary, or other relevant needs are encouraged to contact Envol before booking so that practical arrangements can be discussed.

Retreat participation does not replace medical care and does not guarantee improvements in health or well-being.

9. Withdrawal Rights, Refunds and Consumer Guarantees

Consumers purchasing at a distance may have a statutory right to withdraw from an eligible contract within 14 days without giving a reason.

The application of this right depends on the nature of the product or service and any relevant legal exceptions.

For certain digital content supplied immediately, the statutory right of withdrawal may be lost once access begins, but only when the legal conditions for express prior consent, acknowledgment, and confirmation are satisfied.

For services that begin during the withdrawal period, different rules may apply depending on the nature and extent of performance.

Certain accommodation or leisure services provided on specific dates may be subject to statutory exceptions.

Where a statutory right of withdrawal applies, Envol will provide the legally required information and procedures for exercising that right.

Customers may contact Envol using the contact information in these Terms and any cancellation functionality made available on the Website.

Any voluntary commercial refund policy offered by Envol applies in addition to, and does not replace or restrict, mandatory consumer rights.

9.1 Defective or Unavailable Digital Services

If digital content or a digital service does not conform to the contract, customers may be entitled to corrective measures, a price reduction, termination, or reimbursement under applicable law.

10. Health and Medical Disclaimer

Envol offers complementary well-being experiences and educational content.

The App, Website, programs, retreats, and related materials are not intended to replace medical advice, diagnosis, treatment, or ongoing care by a qualified healthcare professional.

Envol does not guarantee that its Services will prevent, diagnose, treat, or cure any disease or medical condition.

Individual experiences and outcomes may vary.

Users should consult an appropriately qualified healthcare professional about medical concerns, new or worsening symptoms, or changes to their treatment.

Users should not discontinue prescribed treatment or delay seeking medical advice because of content provided by Envol.

Audio experiences should not be used while driving, operating machinery, or carrying out activities requiring continuous attention.

Users should stop an activity if they experience significant discomfort and seek appropriate advice where necessary.

Educational discussions about stress, beliefs, emotions, and symptoms should not be interpreted as claims that psychological factors cause or fully explain a medical condition.

Nothing in this section excludes liability that cannot legally be excluded.

11. User Responsibilities and Acceptable Use

Users agree to use the Services lawfully and respectfully.

Users must not:

  • Access another person’s account without authorization.
  • Interfere with the security or proper functioning of the Services.
  • Distribute malware or use the Services for unlawful purposes.
  • Copy, redistribute, or commercially exploit protected content without authorization.
  • Harass or unlawfully infringe the rights of other users, participants, or staff.
  • Record or share private group or individual sessions without appropriate authorization.

Envol may take proportionate action in response to serious breaches of these Terms, subject to applicable legal obligations.

12. Intellectual Property

Unless otherwise stated, Envol or its licensors own the intellectual property rights in the App, Website, audio experiences, course materials, texts, graphics, branding, and other original content.

Subject to these Terms and any applicable purchase conditions, Envol grants users a limited, non-exclusive, non-transferable right to access and use the Services and content for their personal, non-commercial purposes.

Purchasing access does not transfer ownership of intellectual property.

Users must not reproduce, distribute, sell, sublicense, or commercially exploit protected content without prior authorization, except where permitted by applicable law.

12.1 Content Submitted by Users

Users retain ownership of original materials they submit, subject to any third-party rights.

Where necessary to deliver the requested Services, users authorize Envol to process and use submitted materials for that specific purpose.

Any additional use, including publication of testimonials or identifiable personal stories, will be subject to appropriate permission and applicable privacy law.

13. Privacy and Personal Data

Envol processes personal data in accordance with its Privacy Policy and applicable data protection law.

Depending on the Services used, information may include account details, purchase information, communications, program participation details, and information voluntarily supplied by users.

Where health-related or other sensitive personal information is processed, Envol will apply the additional protections required by law.

Users should consult the Privacy Policy for further details regarding purposes of processing, legal bases, retention periods, recipients, international transfers, and individual rights.

Use of optional analytics, advertising, and similar tracking technologies is addressed in the Cookie Policy and applicable consent mechanisms.

14. Third-Party Services and App Stores

Some Services rely on third-party providers, including hosting providers, payment processors, Apple, Google, video platforms, or communications services.

Separate third-party terms may apply when users purchase or access a Service through those providers.

For App Store and Google Play purchases, applicable platform billing, renewal, cancellation, and refund procedures may apply.

Nothing in these Terms limits rights that users have against Envol under applicable consumer law.

15. Availability, Updates and Changes

Envol aims to provide reliable access to its Services but cannot guarantee uninterrupted availability.

Temporary interruptions may arise from maintenance, technical problems, connectivity issues, or circumstances outside Envol’s reasonable control.

Envol may develop new features, improve existing content, and make reasonable changes to its Services.

Where a change materially affects a purchased Service, Envol will comply with any applicable notice, conformity, reimbursement, or termination requirements.

16. Liability

Envol is responsible for its obligations under applicable law.

To the extent permitted by law, Envol is not responsible for losses caused exclusively by factors outside its reasonable control or by uses of the Services contrary to reasonable safety instructions.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded or restricted.

Nothing limits mandatory rights relating to digital content, consumer contracts, or services.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands, subject to any mandatory consumer protections that apply in the consumer’s country of habitual residence.

Users are encouraged to contact Envol first to seek an amicable resolution of a complaint.

If a dispute cannot be resolved informally, it may be submitted to the competent courts as determined by applicable law.

Nothing in these Terms deprives consumers of mandatory jurisdictional protections.

18. Amendments to These Terms

Envol may update these Terms to reflect changes in its Services, legal requirements, or business practices.

The latest version will be published on the Website with an updated effective date.

Where legally required, users will receive appropriate notice before material changes take effect.

Changes will not retroactively deprive customers of rights under an existing purchase.

19. Language

These Terms may be made available in English, French, and other languages.

In the event of differences between language versions, interpretation will be subject to applicable law, including mandatory requirements concerning the language and transparency of consumer contracts.
